TransUnion, the subpoena respondent, does not consent so transfer is appropriate if the court finds exceptional circumstances. Fed. R. Civ. P. 45(f). Although TransUnion identifies burdens imposed by the subpoena and litigating the motion to quash, those burdens are the same in this district or in the Eastern District of Virginia. Of course, the burden is on Scroggins to demonstrate exceptional circumstances, and consideration should be given to avoid burdens on local nonparties. But the burden should relate to the transfer not the subpoena itself. TransUnion is represented by counsel in Texas; litigating the motion to quash in Illinois is not materially more convenient to TransUnion. Of weightier concern, and what demonstrates exceptional circumstances here, is the relationship between the subpoena and the merits. The TransUnion subpoena is piece of ongoing discovery disputes between the parties, Scroggins and LexisNexis, and resolution of the motion to quash should be informed by whether there are alternative sources of production for the information. This court cannot efficiently evaluate the bigger discovery picture, and that suffices as an exceptional circumstance.
