Filing 4 MINUTE entry before the Honorable Martha M. Pacold: Plaintiffs are ordered to show cause by 2/2/24 why this case should not be dismissed for lack of subject matter jurisdiction. The complaint #1 , premises jurisdiction on the diversity statute, 28 U.S.C. 1332(a), but it does not properly allege the citizenship of the plaintiffs. The plaintiffs allege that Taher Kameli is "a licensed and practicing attorney in the State of Illinois and, at all relevant times, has practiced law through his offices in Chicago, Cook County, Illinois." This fails to establish citizenship for an individual. An individual's citizenship is his domicile. To establish domicile, there must be "physical presence in a state, with an intent to remain there." Denlinger v. Brennan, 87 F.3d 214 (7th Cir. 1996). The complaint next alleges that The Law Offices of Kameli & Associates, P.C. is "an Illinois corporation dissolved on April 8, 2022," and "was owned by the Plaintiff, Taher Kameli." To properly allege jurisdiction for The Law Offices of Kameli & Associates, P.C., plaintiffs should specifically address the following issues, citing appropriate legal authority: (1) the test for the citizenship of a "P.C." for purposes of diversity jurisdiction, and (2) whether the fact that the entity has been dissolved (according to plaintiffs) affects diversity jurisdiction. Plaintiffs may discharge this order by filing a jurisdictional statement by 2/2/24 that properly establishes diversity of citizenship between the plaintiffs and defendant. This statement should include the citizenship of all parties. Failure to comply will result in dismissal for lack of subject matter jurisdiction. (rao, ) |
