First, there is no indication the motion was actually served upon plaintiff. The motion says it was sent to plaintiff "via CM/ECF," but that is not the case: parties do not receive notice via CM/ECF. There is nothing in the certificate of service suggesting that the motion was served upon plaintiff by any other means. Second, the motion in its current form does not state sufficient grounds for withdrawal. It says that counsel "is no longer able to provide the best representation for the client and their legal matter," but that's far too vague, and there is nothing apparent from the record suggesting that anything has changed since counsel filed the lawsuit less than one month ago.
