February 1, 2024 Filing 5 MINUTE entry before the Honorable Jeremy C. Daniel: The plaintiff's motion to proceed in forma pauperis #4 is granted. The plaintiff's complaint, however, is dismissed for failure to state a claim. District courts have the power to screen complaints filed by litigants; and must dismiss complaints that fail to state a claim. Rowe v. Shake, 196 F.3d 778, 783 (7th Cir. 1999) (citing 28 U.S.C. 1915(e)(2)(B)). Here, the plaintiff alleges that defendant Dollar Tree wrongfully terminated the plaintiff's employment as a warehouse worker. According to the plaintiff, the termination violated the Fifth and Fourteenth Amendments by taking away the plaintiff's job without due process, including the opportunity to be heard. Because 1983 provides a right of action for constitutional deprivations that occur under of state law, private actors typically are not subject to suit under 1983. Alarm Detection Sys., Inc. v. Vill. of Schaumburg, 930 F.3d 812, 825 (7th Cir. 2019). Here, the plaintiff does not allege that the defendant acted under color of state law, and the factual allegations set forth in the complaint do not support any inference to that effect.
