March 18, 2024 Opinion or Order Filing 5 ORDER: Plaintiff's application for leave to proceed in forma pauperis #3 is granted. The court orders the trust fund officer at Plaintiff's place of incarceration to immediately deduct $27.90 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to continue making monthly deductions in accordance with this order. As discussed below, the court also orders Plaintiff to pay (and the facility having custody of him to automatically collect and remit) to the Clerk of Court, 40% of any and all deposits to Plaintiff's account until his filing fees have been paid in full. The Clerk is directed to forward a copy of this order to the inmate trust account supervisor at Stateville Correctional Center and to the court's fiscal Department. Having reviewed Plaintiff's complaint pursuant to 28 U.S.C. 1915A, the court concludes that it states a claim, but will not direct that summons issue at this time. Plaintiff's motion for attorney representation #4 is granted. The court recruits Derrick M. Thompson of Taft, Stettinius & Hollister LLP, 111 East Wacker Drive Suite 2800, Chicago, IL 60601, to represent Plaintiff in accordance with counsel's trial bar obligations under N.D. Ill. Local Rules 83.11(h) and 83.37.1 Counsel shall investigate Plaintiff's claims and report to the court as to whether he wishes to submit an amended complaint or to proceed on the existing complaint. Counsel is directed to file an appearance by April 15, 2024 and a status report regarding his investigation of this matter by May 8, 2024. If counsel believes that filing an amended complaint or proceeding with this representation would violate his Rule 11 obligations, he should so inform the court. Pro bono litigation resources are available on the District's website at http://www.ilnd.uscourts.gov, by clicking on the link to Resources for Pro Bono Attorneys in the Trial Bar. In addition, counsel should review Local Rule 54.1 for the rules addressing the taxation of costs and the limits established by the Judicial Conference of the United States and/or published rates on the Court's website.
