March 13, 2024 Filing 9 MINUTE entry before the Honorable Franklin U. Valderrama: Before the Court is Plaintiff's letter #8 , which takes issue with the Court Minute Entry of 2/27/2024 #7 in which the Court found that Plaintiff's complaint #1 does not allege a claim "for wages or salvage or the enforcement of laws enacted for [a seaman's] health and safety." 28 U.S.C. 1916. Nothing in Plaintiff's letter or attachments provides any basis for the Court to reconsider its finding that Plaintiff's complaint does not allege such a claim. Moreover, nothing in Plaintiff's letter of attachments provides a non-frivolous basis for Plaintiff's refusal to file an in forma pauperis application or pay the filing fee. Finally, the Court notes that the threats made in Plaintiff's letter directed towards this Court and the Clerk of Court, specifically, "You are in gross breach of trust and now can be held liable in your private capacity.... Have a new reply issued amending the claim or find yourself answering for the crime of 'treason'...." are not grounded in law and are wholly inappropriate. Further such baseless accusations against Court personnel will result not only in the dismissal of Plaintiff's lawsuit, but may also result in a referral to the Executive Committee to determine whether limitations should be placed on his ability to litigate in this District. The 3/19/2024 deadline to pay the $405 filing fee or file an in forma pauperis application stands #7 . Failure to comply will result in dismissal of the case without prejudice. Mailed notice (axc).

February 27, 2024 Filing 7 MINUTE entry before the Honorable Franklin U. Valderrama: On 2/8/2024, the Court directed Plaintiff to either pay the $405 filing fee or file an in forma pauperis application by 2/29/2024 #4 . On 2/20/2024, Plaintiff filed "exhibits" #6 , which appear to contest that Plaintiff is part of the "citizenry," attaching his birth certificate, and requesting that the Court convert his suit to be a seaman's suit brought under 28 U.S.C. 1916. However, Plaintiff's complaint #1 does not allege a claim "for wages or salvage or the enforcement of laws enacted for [a seaman's] health and safety." 1916. If plaintiff can state such a claim in accordance with Fed. R. Civ. P. 11, he must file an amended complaint. Any such amended complaint must be filed by 3/19/2024. Alternatively, Plaintiff must pay the $405 filing fee or file an in forma pauperis application by 3/19/2024. Failure to comply will result in dismissal of the case without prejudice. See N.D. Ill.
