Maldonado: The parties have informed the Court, via email to the courtroom deputy, that they discussed the pending motions to dismiss and to remand and came to agreement on an order for remand, which the parties submitted to the Court's proposed order inbox. Defendant Aldi indicates in the proposed order that it agrees to consent to remand, and in exchange Plaintiff has agreed to waive his request for attorney's fees and costs in connection with his motion for remand. In light of the parties' agreement, Plaintiff Bengal's motion to remand #11 is granted as unopposed. The Clerk is directed to remand this case forthwith to the Circuit Court of Kane County, Illinois. Plaintiff's request for an award of his reasonable attorney's fees and costs is denied. Defendant Aldi's pending motion to dismiss #6 is denied as moot. Civil case terminated. Mailed notice. (kp, ) |
