Filing 5 MINUTE entry before the Honorable Joan B. Gottschall: The court has heard nothing from self-represented plaintiff Julita Marshall since she filed her complaint and application to proceed without prepaying the filing fee. Plaintiff did not respond to the minute order #4 of 2/15/2024 giving her an opportunity to clarify whether she intended to file this case in state or federal court. Plaintiff has until and including 4/15/2024 to tell the court whether she still wishes to pursue this case. If plaintiff does nothing by the deadline of 4/15/2024, the court will assume that plaintiff no longer wishes to pursue this lawsuit, and it will be dismissed for failure to prosecute in accordance with Fed. Filing 4 MINUTE entry before the Honorable Joan B. Gottschall: Self-represented plaintiff Julita Marshall has filed a complaint #1 and an application #3 to proceed without prepaying the filing fee. On page five of her complaint plaintiff "asserts that this state lawsuit raises valid claims under Federal laws, Illinois Laws, and applicable federal regulations" and "respectfully implores this Honorable Court to evaluate her claims and grant the remedies and relief sought in this state lawsuit." Based on this language, the court directs plaintiff to clarify whether she intended to file this case in state or federal court by and including 2/28/2024. If plaintiff intended to file this case in state court, she may withdraw her complaint and application to proceed without prepaying the filing fee by filing a notice voluntarily dismissing this federal case without prejudice. See Fed. R. Civ. P. 41(a)(1). If plaintiff does nothing by the deadline of 2/28/2024, the court will rule on her application to proceed without prepaying the filing fee and screen her complaint in accordance with 28 U.S.C. 1915(e)(2). Plaintiff is also advised that if she wishes to receive notice of future filings in this case, she must file a pro se appearance form. This form as well as the application to proceed without prepaying the filing fee can be found on the court's official website at https://www.ilnd.uscourts.gov/.
