Filing 9 MINUTE entry before the Honorable John J. Tharp, Jr: Plaintiff's civil cover sheet (Dkt. 2.) invokes an incorrect Cause and Nature of Suit for this case. The Clerk is instructed to update the docket to reflect the correct Cause and Nature information, as follows: Cause "28:1332 Diversity-Personal Injury" and Nature of Suit "360 PI: Other." Mailed notice (air, ) |
Filing 8 ORDER: Upon review of the plaintiff's complaint #1 and pursuant to Fed. R. Civ. P 12(h)(3), the complaint is dismissed without prejudice because there is no identifiable basis for this Court to exercise jurisdiction over the plaintiff's complaint. A complaint must contain a "short and plain statement of the grounds for the court's jurisdiction," which this complaint fails to do. Fed. R. Civ. P. 8(a)(1). Furthermore, the complaint borders on "unintelligible" and is dismissed for failing to set forth "a short and plain statement of the claim showing the pleader is entitled to relief." Fed. R. Civ. P. 8(a)(2); Paul v. Marberry, 658 F.3d 702, 703 (7th Cir. 2011). The plaintiff is given leave to file an amended complaint curing these defects by 03/25/2024. Plaintiff's motions to proceed in forma pauperis #3 and for attorney representation #4 are dismissed without prejudice. Signed by the Honorable John J. Tharp, Jr on 2/26/2024: Mailed notice (daj, ) |
