| Filing 12 MINUTE entry before the Honorable Matthew F. Kennelly: The Court has reviewed the parties' joint status report as well as the complaint and answer. First, defendants' affirmative defense of failure to exhaust under the PLRA is stricken, with leave to amend. The defense says only that plaintiff "did not complete the grievance process regarding some or all of [his] claims," without elaboration or explanation. Defendants have leave to file an amended answer by 4/29/2024 that spells out how defendant contend plaintiff failed to exhaust, and for what claim or claims. The Court adopts the parties' proposed discovery and pretrial schedule, as follows. Rule 26(a)(1) disclosures are to be made by 4/30/2024. Initial written discovery requests are to be served by 5/30/2024. The deadline for amending the pleadings and adding parties is 7/5/2024. Fact discovery is to be completed by 12/5/2024. Rule 26(a)(2) disclosure are due for plaintiff by 1/6/2025, with depositions by 2/5/2025, and for defendants by 3/5/2025, with depositions by 4/7/2025. The deadline for filing dispositive motions is 5/5/2025. The telephonic status hearing set for 4/15/2024 is vacated and reset to 5/7/2024 at 8:55 AM, using call-in number 888-684-8852, access code 746-1053. (mk) |
