Jenkins: Plaintiff's application for leave to proceed in forma pauperis #3 is granted because his application establishes that he is unable to pay the filing fee. 28 U.S.C. 1915(a)(1). Although Plaintiff reports that he worked as recently as last week, he has less than $400 in bank accounts, has substantial credit card debt, and has monthly expenses roughly equal to his previous monthly take-home pay. However, the Court strikes Plaintiff's Complaint #1 because it does not contain "a short and plain statement of the claim showing that" Plaintiff "is entitled to relief." Fed. R. Civ. P. 8(a)(2). Plaintiff states that Delta Air Lines Inc. discriminated and retaliated against him in violation of Title VII, the Americans with Disabilities Act, and the Family and Medical Leave Act. But he did not fill in item E. of the employment discrimination form complaint, which states: "The facts of my case are as follows." If Plaintiff wishes to proceed with this lawsuit, he must file an amended complaint by March 19, 2024 that contains the factual basis for his claims. All that is required is a straightforward account of who Plaintiff alleges discriminated against him, what form the discrimination took, and when and where it occurred. Plaintiff should fill out a new copy of the complaint form and include all relevant information; the Court will not refer back to the original Complaint when evaluating an amended complaint.
