Date Filed Document Text
April 24, 2024 Filing 17 MINUTE entry before the Honorable LaShonda A. Hunt: Telephonic status hearing held. Parties' oral motion to reset the briefing schedule on Defendant's Motion to Dismiss Pursuant to Rule 12(b)(6) #10 is granted. Plaintiff's response is due by 5/16/24, and Defendant's reply is due by 5/30/24. All proceedings are stayed pending ruling on the motion. Emailed notice. (cdh, )
April 18, 2024 Filing 16 MINUTE entry before the Honorable LaShonda A. Hunt: The Court has reviewed the Agreed Motion to Modify Briefing Schedule on Defendant's Motion to Dismiss and to Set Briefing Schedule on Plaintiff's Anticipated Cross-Motion #14 . This case appears to involve a routine insurance coverage dispute. After Defendant filed a motion to dismiss the complaint under Fed. R. Civ. P. 12(b)(6) #10 , the Court set a briefing schedule #13 . In response, Plaintiff requests a revised schedule to include its intended cross-motion for judgment on the pleadings under Fed. R. Civ. P. 12(c) and/or partial summary judgment under Fed. R. Civ. P. 56 (which one is not clear). Frankly, it would be inefficient for the Court and the parties to address three different motions under three different legal standards. Therefore, this motion #14 is granted in part and the briefing schedule #13 on Defendant's Rule 12(b)(6) motion is stricken, and denied in part to the extent the parties seek to expand the motion practice at this early stage in the case. The in-person motion hearing scheduled for 4/24/24 is reset to a telephonic status hearing on 4/24/24 at 9:30AM. Attorneys/Parties should appear for the hearing by calling the Toll-Free Number: 877-336-1828, Access Code: 4082461. Members of the public and media may call in to listen to the hearing. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting court proceedings. Parties should be prepared to discuss next steps to move this case forward. Emailed notice. (cdh, )
