Filing 9 COMPLAINT filed by Aikaterini Phillips. (jh, ) |
Filing 8 MINUTE entry before the Honorable Jeffrey I Cummings: This case has been assigned to the calendar of Judge Jeffrey I. Cummings. Plaintiff's application to proceed in forma pauperis #3 is granted. Plaintiff's motion for attorney representation #4 is denied without prejudice. Although plaintiff indicates that English is not her primary language, she reports she has completed at least some college education and the Court's review of her complaint demonstrates sufficient literacy and communication skills through which to handle this case's early stages. See Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007) (en banc); see also Kindstrom v. Lake Cnty., No. 3:22-CV-50041, 2023 WL 1974531, at *1 (N.D.Ill. Jan. 30, 2023). Moreover, plaintiff who appears to only have contacted one attorney (Deborah Spector) has made an insufficient effort to obtain an attorney to represent her in this matter. Plaintiff may renew her motion for attorney representation after she fully exhausts her effort to obtain counsel and should circumstances change as the case progresses. The parties are strongly encouraged to consider consenting to proceed before the assigned United States Magistrate Judge. Should the parties elect to do so, the appropriate form to execute and file with the court may be found at the following location: https://www.ilnd.uscourts.gov/_assets/_documents/_forms/_online/ConsentForm_NEW_fillable_pdf.pdf. By 4/10/24, the parties shall file a joint status report indicating whether they agree to a remand and whether they consent to reassignment for all purposes to the Magistrate Judge. Status hearing set for 4/15/24 at 9:00 a.m. (to track the case only, no appearance is required). Mailed notice (cc, ) |

If there was a prior remanded case that is not identified on the Civil Cover Sheet in this action, the parties are ordered to file a Notification of the prior case within 30 days. That Notification is to provide the case name, number and assigned judge. (jp, ) |
