March 1, 2024 Filing 8 MINUTE entry before the Honorable Franklin U. Valderrama: Before the Court is Defendant's petition for removal to federal court #1 , as well as the State Court docket #5 and Complaint [1-2]. From the information in the petition for removal and the attached state court records, it appears that Plaintiff alleges claims brought under the Fourth and Fifth Amendments for false arrest and violation of Plaintiff's Miranda rights. Accordingly, it appears that the Court has subject matter jurisdiction over Plaintiff's claims under 28 U.S.C. 1331 and removal was therefore proper under 28 U.S.C. 1441(c)(1)(A). However, under 28 U.S.C. 1446(d), "[p]romptly after the filing of such notice of removal of a civil action the defendant... shall give written notice thereof to all adverse parties and shall file a copy of the notice with the clerk of such State court." Nothing before the Court indicates that Defendant has given Plaintiff or the State Court clerk notice of the removal. Accordingly, by 3/7/2024, Defendant or its counsel is directed to file a declaration on the docket notifying the Court that notice has been given to Plaintiff and to the State Court.
