ORDER: Plaintiff Gregory Stamps's application for leave to proceed in forma pauperis (Dckt. No. #3 ) is granted. The Court orders the trust fund officer at Stamps's place of incarceration to deduct $1.17 from Stamps's account for payment to the Clerk of Court as an initial partial payment of the filing fee and to make monthly deductions per this order. The Court directs the Clerk of Court to send (electronically if possible) a copy of this order to the trust fund officer at Stamps's current place of incarceration and to the Court's Fiscal Department. Summons, however, shall not issue at this time. Based on the complaint, it appears that the Court does not have subject matter jurisdiction over Stamps's claims. But the Court will allow Stamps leave to submit a proposed amended complaint by May 17, 2024. The Court will dismiss the lawsuit if Stamps does not submit an amended complaint. The motion for attorney representation (Dckt. No. #4 ) is denied without prejudice. The Clerk is directed to send Stamps a copy of this order and a blank amended complaint form.
