Date Filed Document Text
April 25, 2024 Filing 16 MINUTE entry before the Honorable Joan B. Gottschall: Defendant's motion #15 to set aside entry of default is denied as unnecessary because no Fed. R. Civ. P. 55(a) default has been entered. As defendant requests in its motion #15 , it has 21 days (until and including 5/15/2024) to answer or otherwise respond to the complaint. Accordingly, the deadline to file a joint initial status report is extended to and including 5/29/2024. Mailed notice (mjc, )
April 23, 2024 Filing 15 MOTION by Defendant CDL 1000, LLC to set aside default (Marino, Herman)
April 23, 2024 Filing 14 MINUTE entry before the Honorable Joan B. Gottschall: On 3/26/2024, plaintiff filed a process server's affidavit #11 averring that the summons and complaint were delivered to Baylon Elfgren ("Clerk") at an address in Springfield, Illinois. Neither in the affidavit nor in plaintiff's motion #12 for entry of an order of default does plaintiff explain the connection between the person served and defendant CDL 1000, LLC. Furthermore, the affidavit of service #11 bears an incorrect case number of 20-cv-1716. For these reasons, plaintiff's motion #12 for entry of an order of default is denied without prejudice. Plaintiff may refile its motion for entry of an order of default within 14 days and explain why service of the summons and complaint comports with Fed. R. Civ. P. 4 and any applicable Illinois law. Mailed notice (mjc, )
