April 22, 2024 Filing 7 MINUTE entry before the Honorable John Robert Blakey: Pro se Plaintiff Tavares Maurice Tankersley sues his former employer, alleging race and national origin discrimination based upon the withholding of taxes from his paychecks, see #1 . But he concedes in his complaint that he never filed a charge with the EEOC. As a result, the Court dismisses Plaintiff's complaint. See Chaidez v. Ford Motor Co., 937 F.3d 998, 1004 (7th Cir. 2019) ("Before bringing a Title VII claim, a plaintiff must first exhaust his administrative remedies by filing charges with the EEOC and receiving a right to sue letter."); Conner v. Illinois Dep't of Nat. Res., 413 F.3d 675, 680 (7th Cir. 2005) ("There are several prerequisites for bringing a Title VII claim. A plaintiff must file a charge with the EEOC detailing the alleged discriminatory conduct within the time allowed by statute, and the EEOC must issue a right-to-sue letter."); Stepney v. Naperville Sch. Dist. 203, 392 F.3d 236, 239 (7th Cir. 2004) ("Under Title VII, a plaintiff in Illinois must file an employment discrimination charge with the EEOC within 300 days after the alleged unlawful employment practice occurred."). If Plaintiff can amend his complaint to cure this deficiency, he may do so by 5/31/24. If he fails to amend by this date, the Court will dismiss this case. Mailed notice (gel, )
