March 12, 2024 Filing 7 MINUTE entry before the Honorable Joan B. Gottschall: Self-represented plaintiff Steve Terrell Giles has filed a complaint #1 under 42 U.S.C. 1983 against the City of Chicago, the Cook County Sherrif's Department, the Cook County Department of Corrections ("CCDOC"), and others not specifically named in the complaint. Plaintiff alleges that, while he was in CCDOC custody, corrections officers physically attacked him on 3/9/2022. He brings claims for use of excessive force, for failure to intervene, and for failure to provide adequate medical care after the attack. See Compl. 2. In his complaint and on his civil cover sheet #2 , plaintiff states that this case is related to, and a refiling of, his complaint in No. 23-cv-2461. Compl. 1. Cover Sheet 1. On June 30, 2023, Judge Rowland entered an order and a separate judgment dismissing case no. 23-cv-2461. Local Rule 40.3(b)(2) provides, "When a case is dismissed with prejudice or without, and a second case is filed involving the same parties and relating to the same subject matter, the second case shall be assigned to the judge to whom the first case was assigned. The designation sheet presented at the time the second case is filed shall indicate the number of the earlier case and the name of the judge to whom it was assigned." Upon review of the complaints filed in this case and in no. 23-cv-2461, the court finds that both cases involve the same subject matter, the alleged attack on 3/9/2022, and that, with the exception of the City of Chicago, plaintiff is bringing claims in no. 24-cv-1994 against a subset of the defendants named in no. 23-cv-2461. Accordingly, the clerk is instructed to forward this case to the Executive Committee with a recommendation that it be reassigned to Judge Rowland in accordance with Local Rule 40.3(b)(2).
