Filing 9 MINUTE entry before the Honorable Manish S. Shah: The motion to vacate #8 is denied. The motion asserts that federal judges may be sued under the principles of Bivens, but that is not correct. Such a claim would be an unwarranted extension of the Bivens case. In any event, there was no manifest legal or factual error in the entry of judgment. The court explained its reasons, albeit in a docket entry and not in a memorandum opinion, and any issues with the processing of plaintiff's filing fee do not undermine the rationale for dismissing the complaint. This case remains closed. Plaintiff should consult Federal Rule of Appellate Procedure 4 for information about his appellate rights and the deadlines for filing a notice of appeal. Notices mailed. Filing 6 MINUTE entry before the Honorable Manish S. Shah: The court, on its own motion, dismisses plaintiff's complaint with prejudice for failure to state a claim, absolute immunity, and as frivolous. Federal judges are not amenable to suit under Section 1983, and they are absolutely immune from lawsuits arising out of their judicial decisionmaking. The allegations that the judges improperly managed or ruled on plaintiff's cases do not plausibly suggest any conduct so far outside the realm of judicial conduct to fall outside the scope of absolute judicial immunity. There are no plausible allegations against the Illinois Attorney General or United States Department of Justice officials; plaintiff seems to name them solely for the purpose of seeking their assistance in vindicating his claims. But naming such officials as defendants (or respondents) in a civil lawsuit is not a mechanism for getting executive branch officials to assert their prosecutorial or regulatory powers. The Justices of the United States Supreme Court are not amenable to suit (in their supervisory capacity over the rules of procedure) either. Enter judgment and terminate civil case.
