March 27, 2024 Filing 3 MINUTE entry before the Honorable John Robert Blakey: Plaintiff Dezzan Phillips, who is detained in the LaSalle County Jail, filed this lawsuit against a relative who allegedly shot him. Plaintiff initiated this lawsuit without pre-paying the $405.00 filing fee or filing an application to pay the fee in installments. Plaintiff must do one of two things if he wants to proceed with this case: (1) pre-pay the $405.00 filing fee by submitting a check or money order (labeled with Plaintiff's name and this case number) to the Clerk of Court, United States District Court, 219 South Dearborn Street, Chicago, Illinois 60604, attn: Cashier's Desk, 20th Floor; or (2) submit a properly completed in forma pauperis application. The application must be certified by a trust fund official at the jail and accompanied by a copy of Plaintiff's trust fund statement for the six months preceding the filing of this lawsuit, or as much of that period as he has been in custody. If Plaintiff fails to comply by 4/29/24, the Court will dismiss this case. Plaintiff must pay the full filing fee regardless of the outcome of the case. 28 U.S.C. 1915(b)(1). If Plaintiff is allowed to pay in installments, collections from his account will follow him even if he is transferred to another facility. Waiver of the filing fee is not an option. Butler v. Deal, 794 F. App'x. 542, 544 (7th Cir. 2020) (unpublished). The Court directs the Clerk to send Plaintiff a blank in forma pauperis application and a copy of this order; consideration of the complaint is deferred pending resolution of Plaintiff's fee status.
