April 2, 2024 Filing 8 MINUTE entry before the Honorable Jorge L. Alonso: On 4/01/2024, Plaintiff filed a complaint #1 , application to proceed in forma pauperis #4 , and motion for attorney representation #5 . The case was assigned to the Honorable Elaine E. Bucklo. Although Plaintiff did not file any motion on the docket, she scheduled an emergency hearing for 4/02/2024. The Honorable L. Alonso, acting as emergency judge, read and considered Plaintiff's complaint and the exhibits thereto and heard Plaintiff in open court. Currently pending in the Circuit Court of Cook County Domestic Relations Division, Case No. 2020 D 79452, is a petition for a rule to show cause filed against Plaintiff in conjunction with a petition for attorneys' fees. The petition for a rule to show cause is scheduled to be heard in the state court case today. Judge Alonso construed Plaintiff as moving for a stay of those state court proceedings. The Anti-Injunction Act states: "A court of the United States may not grant an injunction to stay proceedings in a State court except as expressly authorized by Act of Congress, or where necessary in aid of its jurisdiction, or to protect or effectuate its judgments." 28 U.S.C. 2283. "Any doubts about the Act's three specifically defined exceptions... ought to be resolved in favor of permitting the state courts to proceed." Trs. of Carpenters' Health & Welfare Tr. Fund of St. Louis v. Darr, 694 F.3d 803, 805 (7th Cir. 2012) (citations and internal quotation marks omitted). Based on the Anti-Injunction Act, and for the reasons stated on the record in open court, the Court does not find a basis on which to grant a stay of the state court proceedings. Accordingly, Plaintiff's motion to stay is denied without prejudice. Plaintiff's application to proceed in forma pauperis #4 and motion for attorney representation #5 are taken under advisement for Judge Bucklo's consideration and decision.
