Filing 5 ORDER signed by the Honorable Edmond E. Chang. For the reasons stated in the Order, the Plaintiff's application to proceed in forma pauperis #3 is granted. The initial filing fee is waived. The trust-fund officer at Plaintiff's place of incarceration is authorized to make deductions in accordance with this order as set forth below. The Court directs the Clerk of Court to send a copy of this order (electronically if possible) to the trust fund officer at the facility having custody of Plaintiff and to the court's fiscal department. However, summons shall not issue. Plaintiff's complaint #1 is dismissed pursuant to 28 U.S.C. 1915A for failure to state a claim. The dismissal is without prejudice, and the Plaintiff may submit an amended complaint by 05/28/2024. Failure to submit an amended complaint by that date will result in dismissal of this case with prejudice. The Clerk will send the Plaintiff with an amended complaint form, instructions, and one blank USM-285 form, along with a copy of this order. The Court advises the Plaintiff that a completed USM-285 form for each named Defendant should be submitted along with any amended complaint. The U.S. Marshal will not attempt service on a Defendant unless and until the required form for that Defendant is received. The Plaintiff must keep the Court apprised of her most up-to-date address information and if she fails to do so, this case may be dismissed. The motion for attorney representation #4 is denied without prejudice for the reasons contained in this order.
