The Court will adopt the parties' proposed schedule with a minor modification or two, but initially, the citizenship of the defendant needs to be cleared up by defendant, the party that removed the case to federal court. The defendant is "K&G Men's Co. LLC," which suggests that (contrary to the allegations in the complaint and the notice of removal), the defendant is a limited liability company and not a corporation. The citizenship of a limited liability company is that of each of its members, and if any member is itself an entity, citizenship must be traced all the way through. Defendant is directed to file an amended notice of removal by 7/19/2024 that accurately describes what sort of entity defendant is, and if it is in fact an LLC as its title suggests, the amended notice must accurately describe its citizenship in full. The Rule 26(f) conference is to take place by 7/22/2024. Rule 26(a)(1) disclosures are to be made by 8/19/2024. Written discovery requests are to be served by 8/30/2024. Written discovery is to be completed by 10/4/2024. Oral fact discovery (including medical fact discovery) is to be completed by 12/16/2024. Rule 26(a)(2) disclosures are to be made by 1/14/2025. Depositions of any Rule 26(a)(2) witnesses are to be completed by 3/3/2025. The deadline for completing all fact discovery including motions regarding fact discovery is 5/5/2025.
