TEXT ORDER entered by Chief Judge Sara Darrow on May 13, 2024. Plaintiff Christina Silvera filed a #1 complaint against Maxim Healthcare Staffing Services, Inc. ("Maxim") and Mabley Family Association, Inc. d/b/a Jack Mabley Developmental Center ("Mabley") on January 3, 2024. Maxim (n/k/a Amergis, see, e.g., #14 Mot. Compel Arbitration 1 & n.1) argues that Silvera's claims should be dismissed because Silvera and Maxim are parties to an arbitration agreement and Silvera should therefore be compelled to arbitrate. See, e.g., #7 Maxim Answer 12; see generally #14 Mot. Compel Arbitration. Silvera and Maxim have now filed a #18 Stipulation to Dismiss Claims Against Maxim Healthcare Staffing Services, Inc. to Proceed to Arbitration, stating that Silvera and Maxim agree to the dismissal of all claims against Maxim without prejudice so that the parties can arbitrate their dispute. #18 Stipulation 1. The parties do not cite to any legal authority or procedural rule to support their #18 Stipulation. Generally, an attempt to voluntarily dismiss only certain claims from a complaint should be treated as a motion to amend the complaint. Taylor v. Brown, 787 F.3d 851, 858 (7th Cir. 2015) (finding a request to voluntarily dismiss individual parties or claims to be a motion to amend the complaint under Federal Rule of Civil Procedure 15). The Court therefore construes Silvera and Maxim's #18 stipulation as a motion to amend the #1 complaint under Federal Rule of Civil Procedure 15(a)(2) which allows a court to give a party leave to amend its complaint and provides that such leave should be "freely give[n]... when justice so requires." Fed. R. Civ. P. 15(a)(2). The claims against Maxim (n/k/a Amergis) are DISMISSED WITHOUT PREJUDICE. The Clerk is directed to terminate Maxim Healthcare Staffing Services, Inc. as Defendant on the docket. In accordance with the Court's ruling, Maxim's #14 motion to compel arbitration is MOOT. Additionally, Mabley filed a #11 motion to dismiss on March 20, 2024, arguing, among other things, that venue is not proper and the case should be transferred to the Northern District of Illinois. #11 Mabley Mot. Dismiss 6-7. Based on Mabley's #11 motion to dismiss, Silvera #13 now moves to transfer venue pursuant to 28 U.S.C. 1406. #13 Mot. Transfer Venue 2 ("Plaintiff concedes that this case should have been brought in the Northern District of Illinois-Western Division.... Plaintiff respectfully requests that this Honorable Court transfer this case..."); 28 U.S.C. 1406(a) ("The district court of a district in which is filed a case laying venue in the wrong division or district shall dismiss, or if it be in the interest of justice, transfer such case to any district or division in which it could have been brought."). Mabley did not file a response in opposition to the #13 motion to transfer. The #13 motion to transfer is GRANTED. Pursuant to 28 U.S.C. 1406(a) and in the interests of justice, the Court ORDERS this case be TRANSFERRED to the Northern District of Illinois, Western Division.
