Poelstra, 320 F.3d 761, 763 (7th Cir. 2003) ("District judges have ample authority to dismiss frivolous or transparently defective suits spontaneously, and thus save everyone time and legal expense. This is so even when the plaintiff has paid all fees for filing and service."). Plaintiff Daanya Aiera Nala El doing business as Darnissa Teres Joy Gray brings a "Complaint in Bill of Equity" against various state officials related to an ongoing criminal prosecution. #1 Plaintiff alleges, among other things, that "Defendants wrongfully and with ill intentions ignored by 'doing business as' certificate received from Kane County and violently trespassed upon my trust, that being 'Darnissa Teres Joy Gray Estate.'" Plaintiff alleges violations of various securities and financial laws (plus treason) related to Plaintiff's rights in "the estate." Plaintiff seeks damages and dismissal of the pending criminal case, among other remedies. There are two major problems with Plaintiff's complaint. First, it invokes sovereign citizen theories that "should be rejected summarily, however they are presented." United States v. Benabe, 654 F.3d 753, 767 (7th Cir. 2011). Second, Plaintiff expressly asks the Court to dismiss the pending state criminal case, so this Court must abstain under the doctrine of Younger abstention. SKS & Assocs., Inc. v. Dart, 619 F.3d 674, 677-78 (7th Cir. 2010) ("The Younger doctrine requires federal courts to abstain from taking jurisdiction over federal constitutional claims that seek to interfere with or interrupt ongoing state proceedings.... The original core of Younger abstentionfrom Younger itselfrequires federal courts to abstain when a criminal defendant seeks a federal injunction to block his state court prosecution on federal constitutional grounds."). The Court is not convinced a claim can proceed no matter how presented, but it will grant Plaintiff leave to file an amended complaint by August 2, 2024. Plaintiff is warned that the Court will summarily dismiss claims based on sovereign citizen theories, and if that leaves any viable claims without sufficient support, the Court will dismiss them too.
