Gottschall: The certificate of service accompanying plaintiff's motion #21 for temporary restraining order states that plaintiff served the motion upon all counsel of record and interested parties via the CM/ECF system. Nothing in the certificate or the motion papers indicates that plaintiff gave notice of the motion to the non-party providers of services named in paragraphs two and four of the proposed temporary restraining order. This court's standing order in Lanham Act counterfeit product cases provides: "Counsel should be aware that pursuant to Seventh Circuit authority, under Fed. R. Civ. P. 65(d)(2), third parties not named in the complaint cannot be named as in active concert or participation with the defendants unless their active concert or participation is proven AND they receive advance notice and an opportunity to be heard before any such order is entered. Any proposed order not complying with the cases identified here will be rejected. Please see the following cases: Lake Shore Asset Management Limited v.
