September 16, 2024 Opinion or Order Filing 8 ORDER: Pro se plaintiff Kevin Smith, an inmate at the Metropolitan Correctional Center, brings this action against Judge John F. Kness who is presiding over plaintiff's ongoing federal criminal case alleging violations of his constitutional rights. However, not only did plaintiff fail to pay the filing fee or file a proper application to proceed in forma pauperis but, for the reasons set forth below, plaintiff's complaint is dismissed with prejudice as frivolous. This dismissal counts as a strike under 28 U.S.C. 1915(g). The Clerk is directed to enter final judgment and send plaintiff a copy of this order. Civil case terminated.
