Filing 7 MINUTE entry before the Honorable Franklin U. Valderrama: Plaintiff Gardell Delmaro Yancey has submitted a complaint that repeats, nearly verbatim, allegations he raised in earlier cases that were dismissed with prejudice. He did not appeal from the entry of final judgment in those cases. See Case Nos. 23-cv-3426, 23-cv-15398, 23-cv-16874, 24-cv-02048 (N.D. Ill.). As another Judge advised Mr. Yancey in his most recent case filed prior to the instant case, he cannot keep filing a complaint that relates to the same facts in cases that were closed with prejudice. Case No. 24-cv-02048, Dkt. 7 (N.D. Ill. Mar. 13, 2024). Accordingly, for the same reasons his earlier complaints were dismissed, as well as the reason that claim preclusion bars any effort to bring claims that were or could have been raised in the earlier cases, this complaint is dismissed with prejudice and the application to proceed without prepayment of fees #4 and for recruitment of counsel #5 are denied. Enter judgment and terminate civil case. The court in Case No. 24-cv-02048 warned "Mr. Yancey that filing the same case again may result in sanctions for frivolous filings or a referral to the court's Executive Committee to consider imposing restrictions on Mr. Yancey's ability to file documents with the Clerk's Office." Dkt. 7 (N.D. Ill. Mar. 13, 2024). However, Mr. Yancey did not heed that court's warning, because, as stated above, he filed yet another complaint alleging nearly identical allegations to his earlier four lawsuits. Accordingly, the Court refers this case to the court's Executive Committee for consideration of a barring order. Mailed notice. (jcm) |
