Gottschall: In paragraph one of its complaint, plaintiff alleges that it "is a national bank association with its principal place of business located at" an address in Chicago. "In contrast to the ordinary operation of our adversarial system, [federal] courts are obliged to notice jurisdictional issues and raise them on their own initiative." Hamer v. Neighborhood Hous. Servs. of Chi., 583 U.S. 17, 21 (2017) (citing Henderson v. Shinseki, 562 U.S. 428, 434 (2011)). For purposes of federal diversity jurisdiction under 28 U.S.C. 1332(a), a national bank "is a citizen of the State in which its main office, as set forth in its articles of association, is located." Wachovia Bank v. Schmidt, 546 U.S. 303, 307 (2006) (construing 28 U.S.C. 1348). Because the complaint does not make clear whether plaintiff's "principal place of business" listed in paragraph one is also plaintiff's main office as set forth in its article of incorporation, plaintiff is instructed to file an amended complaint on or before 10/22/2024.
