| Filing 20 MINUTE entry before the Honorable Georgia N Alexakis: The Court has reviewed the parties' joint status report #19 . In the report, plaintiffs assert that this matter has been improperly removed to federal court and that the Court may lack subject matter jurisdiction. A status report is not the appropriate vehicle for raising this issue. The Court directs plaintiffs to file a motion advancing their argument on or before 1/3/25. Defendants' response is due on or before 1/17/25. Plaintiffs' reply is due on or before 1/24/25. In addition, in the status report, the parties state that they agree that discovery should be stayed while defendants' motion to dismiss remains pending. Although the filing of a dispositive motion does not automatically stay discovery, the Court agrees with the parties that a stay is appropriate here given that defendants' pending motion (and plaintiffs' soon-to-be pending motion) have the potential to resolve this case. The Court, therefore, in its broad discretion to manage its docket and control case schedules, determines that a stay of discovery is appropriate. In light of the pending briefing, the Court vacates the 12/17/24 status hearing. (ca, ) |
