December 23, 2024 Opinion or Order Filing 5 ORDER: Plaintiff Antwon Newell, a prisoner at the Pinckneyville Corrections Facility, initiated this pro se civil rights action with a complaint that appears to allege several constitutional violations while he was a pretrial detainee at the Will County Detention Facility. He appears to claim that he was unlawfully detained and that he was also subjected to excessive force when a guard tasered him. These claims are nearly identical to those in another case he has filed, Newell v. Will County Adult Detention Facitily et al, 1:24-cv-11658 (N.D. Ill.). He has not paid the fee in this case, nor has he applied to proceed in forma pauperis. The Court will close this case as duplicative of case no. 24-cv-11658 without assessing the filing fee, and without prejudice to Plaintiff pursuing his claims in the earlier-filed case. The Court makes no assessment as to the substantive merits of any such claim(s). It is, however, Newell's responsibility to track the cases that he has filed (as well as the claims within them), and should he file future duplicative lawsuits, he may be assessed a filing fee and the duplicative lawsuit may be dismissed with prejudice as frivolous or malicious. November 18, 2024 Opinion or Order Filing 3 ORDER: Plaintiff initiated this lawsuit without prepaying the filing fee or filing an application for leave to proceed in forma pauperis. Plaintiff must either: (1) submit a completed application for leave to proceed in forma pauperis that includes a certified copy of the trust fund account statement (or institutional equivalent) for the six-month period immediately preceding the filing of the complaint and a completed certification from the appropriate official of each prison where Plaintiff is or was confined during the last six months; or (2) pay the full statutory filing fee of $405. Failure to comply with this order by December 4, 2024, will result in summary dismissal of this lawsuit.
