June 25, 2025 Filing 26 MINUTE entry before the Honorable Jeffrey T. Gilbert: Status hearing held on 6/25/25. The Court reviewed the parties' Joint Status Report #25 . This case was referred #21 for supervision of certain limited discovery Plaintiff wanted to take before responding to Defendant's Motion to Compel Arbitration #16 . During a hearing before the assigned District Judge on 6/2/25 #21 , Defendant did not oppose some limited discovery on the Motion to Compel Arbitration. See Transcript of 6/2/25 hearing, Exhibit 1 to the parties' last Joint Status Report [25-1] at pages 3-4. (The parties should note that during today's hearing, the Court mistakenly said that hearing occurred on 6/20/25. It did not; the referenced transcript was filed on that date but the hearing occurred on 6/2/25.) Defendant, however, now says "after further review of Plaintiff's claims and the alleged reasons that discovery is sought, discovery is neither appropriate nor necessary for the Court to decide the pending Motion to Compel Arbitration." See Joint Status Report #25 at 3. During today's hearing, Defendant objected to Plaintiff proceeding with any discovery on the Motion to Compel Arbitration because Defendant now believes the issues to be decided in connection with that Motion are purely legal issues, and no factual discovery is necessary for the District Judge to rule on that Motion. In this Magistrate Judge's view, I now would need to wade into dispositive merits matters that will be decided in the context of the Motion to Compel Arbitration to determine whether Plaintiff or Defendant is correct on the threshold question of whether any discovery is necessary on that Motion. That inquiry and any ruling in that regard is beyond the scope of this referral as this Magistrate Judge interprets it. As explained on the record during today's hearing, Defendant's change in position makes it impossible to accomplish the purpose of the referral #21 which was to supervise discovery regarding the Motion to Compel Arbitration. Plaintiff's unopposed oral motion to strike the briefing schedule #20 set on the Motion to Compel Arbitration #16 until the parties sort out with the District Judge whether Plaintiff is entitled to any discovery before responding to that Motion is granted for the reasons stated on the record. Accordingly, all matters relating to the referral of this matter having been addressed, at least for the time being, this case is returned to the District Judge. Referral terminated.
