| Filing 23 MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff commenced this civil action by filing a 100-page class action complaint #1 under 1 of the Sherman Act, 15 U.S.C. 1 et seq., and the Commodity Exchange Act, 7 U.S.C. 9 et seq., on April 24, 2025. Within three weeks and before any defendant appeared, plaintiff filed a notice #22 purporting to dismiss the case voluntarily without prejudice under Fed. R. Civ. P. 41(a)(1)(A)(i).The rule permitting a plaintiff to dismiss an action voluntarily without a court order is "Subject to Rules 23(e)," among other rules. Fed. R. Civ. P. 41(a). Rule 23(e) provides: "The claims, issues, or defenses of a certified class-or a class proposed to be certified for purposes of settlement-may be settled, voluntarily dismissed, or compromised only with the court's approval," and specifies sending notice and holding a fairness hearing. The Seventh Circuit has held that Rule 23(e), must be observed not only where the court has certified a class but also where a plaintiff settles or voluntarily dismisses a "putative [class], that is, the class alleged in the complaint." Culver v. City of Milwaukee, 277 F.3d 908, 914 (7th Cir. 2002) (citations omitted); See In re AT&T Mobility Wireless Data Servs. Sales Litig., 270 F.R.D. 330, 351 (N.D. Ill. 2010). However, "if it is plain that there is no prejudice, violation of the rule is harmless and compliance will not be ordered." Culver, 277 F.3d at 915 (citations omitted). In view of these authorities, plaintiff is instructed to file a brief memorandum of law on or before May 21, 2025, making clear for the record, if it is indeed the case, that there is no prejudice to the class.Mailed notice (mjc, ) |
