| Filing 10 MINUTE entry before the Honorable Franklin U. Valderrama: Plaintiff has submitted correspondence that the Court construes as a notice of voluntary dismissal #9 . In the correspondence, he states: "I will not pursue any further in Case No. 25 C 5282 any longer." Id. To the extent the correspondence #9 can be construed as a motion, it is granted. His notice is immediately effective under Federal Rule of Civil Procedure 41(a)(1)(A). See Fed. R. Civ. P. 41(a)(1)(A) (stating that, generally, "the plaintiff may dismiss an action without court order by filing: (i) a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment"); Smith v. Potter, 513 F.3d 781, 782-83 (7th Cir. 2008) (finding that motion that was "[i]n substance" a Rule 41(a)(1)(A) notice of dismissal "effected dismissal of the suit"). This case therefore is dismissed without prejudice. Case terminated. With respect to the filing fee in this case, the initiation of the suit creates an irrevocable obligation to pay the filing fee. See Newlin v. Helman, 123 F.3d 429, 433 (7th Cir. 1997) (noting that once a prisoner files a notice of appeal, "the appellant irrevocably incurs an obligation to pay the fee"), overruled on other grounds by Lee v. Clinton, 209 F.3d 1025 (7th Cir. 2000). Accordingly, although the case is closed, Plaintiff remains responsible for the filing fee. Mailed notice. (jcm) |

ORDER: For the reasons stated in the accompanying order, the Court dismisses Plaintiff's complaint #1 without prejudice for failure to state a claim. As further explained in the order, the Court additionally grants Plaintiff's motion to proceed in forma pauperis #4 , denies his motion for attorney representation #3 , and denies his motion for service at the Government's expense #5 . Plaintiff may submit an amended complaint by 10/6/2025 that complies with the Court's order. If he fails to comply, this case will be subject to dismissal with no further warning.
