| Filing 9 MINUTE entry before the Honorable Andrea R. Wood: Telephonic show cause hearing held on 2/25/2026. Plaintiff Kevin Bryant failed to appear. This is the second consecutive hearing for which Plaintiff Bryant has failed to appear. Plaintiff Bryant also has not made any filings since initiating the case on 9/9/2025; nor does it appear that he has returned the USM-285 forms necessary for the Marshals to proceed with service. By order dated 1/27/2026 #8 , Plaintiff Bryant was warned that failure to appear for the show cause hearing on 2/25/2026 may result in the case being dismissed for want of prosecution and failure to comply with the Court's orders. Despite this warning, Plaintiff Bryant did not appear or otherwise respond to the Court's order. Accordingly, this case is dismissed without prejudice for want of prosecution and failure to comply with the Court's orders. The dismissal is without prejudice due to the early stage at which Plaintiff has abandoned the case. Civil case terminated. Mailed notice (lma, ) |
| MAILED Order #8 dated 1/27/26 to Plaintiff Kevin R Bryant. (vkm, ) |
| Filing 8 MINUTE entry before the Honorable Andrea R. Wood: Telephonic status hearing held on 1/27/2026. Plaintiff Kevin Bryant failed to appear. The Court notes that the docket does not reflect Plaintiff's return of completed USM 285 service forms so that the Marshals Service can complete service of process. Plaintiff Bryant is ordered to appear for the next hearing (by telephone) to confirm that he desires to continue with this case. Failure to appear may result in this case being dismissed for want of prosecution and failure to comply with the Court's order of 12/5/2025 #5 . The Clerk is directed to send a copy of this order to Plaintiff's address on the docket. Telephonic show cause hearing set for 2/25/2026 at 10:30 AM. The call-in number is (650) 479-3207 and the access code is 1808131170. To ensure public access to court proceedings, members of the public and media may call in to listen to telephonic hearings. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court-issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court. | Filing 7 ANNUAL REMINDER: Pursuant to #Local Rule 3.2 (Notification of Affiliates)#, any nongovernmental party, other than an individual or sole proprietorship, must file a statement identifying all its affiliates known to the party after diligent review or, if the party has identified no affiliates, then a statement reflecting that fact must be filed. An affiliate is defined as follows: any entity or individual owning, directly or indirectly (through ownership of one or more other entities), 5% or more of a party. The statement is to be electronically filed as a PDF in conjunction with entering the affiliates in CM/ECF as prompted. As a reminder to counsel, parties must supplement their statements of affiliates within thirty (30) days of any change in the information previously reported. This minute order is being issued to all counsel of record to remind counsel of their obligation to provide updated information as to additional affiliates if such updating is necessary. Filing 4
ORDER: Plaintiff has filed a pro se complaint #1 and an application to proceed in forma pauperis #3 . As a preliminary matter, the Court notes that Plaintiff's application to proceed in forma pauperis does not use the Court's standard form for non-prisoner cases. While this could provide a basis to deny Plaintiff's request to proceed in forma pauperis, the Court finds that the information Plaintiff provides on his form is sufficient for the Court to determine that he is unable to pay the fees associated with filing this action. Accordingly, Plaintiff's application for leave to proceed in forma pauperis #3 is granted and the filing fee is waived. The U.S. Marshal is appointed to serve Defendants. The Clerk is directed to docket Plaintiff's complaint #1 , issue summonses for service on Defendants by the U.S. Marshal; and (3) send Plaintiff a blank USM285 service form for each Defendant, a magistrate judge consent form, filing instructions, and a copy of this Order. The Court advises Plaintiff that a completed USM-285 form is required for service on each Defendant. Alternatively, Plaintiff may elect to serve Defendants or request a waiver of service on his or her own. Telephonic status hearing set for 1/27/2026 at 10:00 AM. Signed by the Honorable Andrea R. Wood on 12/5/2025. Mailed notice. (vjd, )
