Pallmeyer: The court thanks counsel for the amended complaint #9 but remains concerned about the propriety of exercising jurisdiction over this case, brought by one Chinese citizen against another, in a federal court in Chicago. Plaintiff is directed to provide evidentiary support for the allegations that "in 2024 and 2025 alone, Defendant's RANPHEE store has sold and shipped tens of thousands of items to U.S. consumers, including thousands of items sold and shipped to consumers in Illinois" and that "infringement of Plaintiff's copyrights cannot be sued in China because the infringing products are not sold in China." (Amended Complaint, 3, 4.) In light of the allegation that "Defendant has offered their infringing products for sale throughout the United States" (id. 11), the court also directs Plaintiff to explain its choice to file this lawsuit in Illinois rather than another state. | Filing 8 MINUTE entry before the Honorable Rebecca R. Pallmeyer: Plaintiff, a Chinese citizen, has sued a Chinese corporation in this court for copyright infringement. Plaintiff alleges that Defendant "has engaged in the unauthorized promotion and sale of products that incorporate one or more of Plaintiff's copyrighted designs and images." (Amended Complaint #5 7.) In a November 20, 2025 order, the court directed that Plaintiff show cause why the case should not be dismissed for lack of personal jurisdiction #6 . In response, Plaintiff reports that she herself placed an order for an accused product "from a Chicago-based address" and received a shipment of the order on November 5, 2025, ten days before filing this lawsuit. In support of this assertion, she has submitted what appears to be a redacted Amazon order confirmation. The name and street address are redacted, leaving the court puzzled; why would a Chinese citizen order a garment for delivery in Chicago? At a minimum, the court would expect submission of an unredacted order confirmation and better authority in support of Plaintiff's theory that a single shipment of a garment from one Chinese citizen to another establishes personal jurisdiction in federal court in Chicago. In the single case she has cited in support of her claim, NBA Properties, Inc. v. HANWJH, 46 F.4th 614 (7th Cir. 2022) the Seventh Circuit affirmed a finding of personal jurisdiction and entry default judgment in a case against a non-resident defendant. But the court recognized that a different result is appropriate in a situation where the plaintiff's counsel had "submitted an online purchase receipt" showing that "he purchased and received a single patented product in Illinois" a purchase the court characterized as "conjured up by the plaintiffs' attorney for the exclusive purpose of establishing personal jurisdiction over the defendants." Id. at 623, citing Matlin v. Spin Master Corp. 921 F.3d 701 (7th Cir. 2019). In such circumstances, exercise of jurisdiction offends traditional notions of "fair play and substantial justice." This case is dismissed without prejudice to the filing, within 28 days, of an amended complaint that makes a more robust showing in support of a claim of personal jurisdiction and proper venue.
