Hunt: Upon review of Plaintiff's response #15 , the Court finds that Plaintiff has sufficiently alleged personal jurisdiction at this early stage of the case. However, Plaintiff is reminded that personal jurisdiction must be proven to support entry of a judgment and merely alleging that defendant "accepted" an order from an Illinois customer and "participated" in a transaction to sell an infringing product does not necessarily satisfy the requirement that "they prove actual sales in Illinois." Liu v. Monthly, No. 25-2074, 2026 WL 880018, at *2 (7th Cir. Mar. 31, 2026). By 5/8/26, Plaintiff is ordered to file a status report proposing next steps in this case, if other appropriate relief has not been sought by that date. | Filing 14 MINUTE entry before the Honorable LaShonda A. Hunt: This case has been assigned to Judge LaShonda A. Hunt. Upon review of the copyright infringement amended complaint #12 and other filings, the Court questions whether Plaintiff has sufficiently alleged personal jurisdiction over the defendants. To adequately plead personal jurisdiction, Plaintiff must sufficiently allege that the defendant actually sold the allegedly infringing product to a customer in Illinois. See Liu v. Monthly, No. 25-2074, 2026 WL 880018, at *1 (7th Cir. Mar. 31, 2026) (citing Curry v. Revolution Lab'ys, LLC, 949 F.3d 385, 400 (7th Cir. 2020)). Plaintiff's amended complaint alleges sales in this district, but those allegations are conclusory and Plaintiff did not provide proof of actual sales in this district. See id. (remanding with instructions to dismiss for lack of personal jurisdiction because plaintiff had not provided screenshot evidence of actual sales in Illinois). Accordingly, Plaintiff has not sufficiently alleged that the Court has personal jurisdiction over the Defendant and must file proof of actual sales in Illinois by 4/29/26. Failure to do so will result in the amended complaint being dismissed without prejudice and this case being closed. Moreover, when a plaintiff files an amended complaint against a sole defendant, there is no need for an amended Schedule A listing the sole defendant; the plaintiff should only name the proper sole defendant in the amended complaint. The Clerk's office is directed, forthwith, to update the caption / case title and parties on the docket to reflect that the sole only remaining Defendant in this case is Defendant "Sweatshirt e".
