MEMORANDUM Opinion and Order: Bernard's claims that accrued before October 23, 2013, are barred by the statute of limitations. Bernard's requested injunctive relief is denied as moot. Furthermore, Defendants' motion for summary judgment regarding the remaining claims 119 is granted, and Bernard's motion for partial summary judgment [132, 137] is denied. ORDER Adopting Report and Recommendations: Before the court is a report and recommendation ("R&R") 77 by the magistrate judge that plaintiff's motion to dismiss 72 be granted and that defendant Erica Barnes be dismissed from the ca se with prejudice. After being afforded a sufficient opportunity, neither party has offered any objection to the R&R. Accordingly, there being no written objection to the R&R of the magistrate judge, see 28 U.S.C. § 636(b)(1); Fed. R. Ci v. P. 72(b); Thomas v. Arn, 474 U.S. 140, 149-50 (1985), and the court having reviewed the R&R, the court accepts the R&R and Erica Barnes is now terminated from the case with prejudice. ORDER : Plaintiff's motion for leave to proceed in forma pauperis 3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $3.37 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk of Court shall send a copy of this order to the trust fund officer at Pontiac Correctional Center. However summo nses shall not issue at this time. Plaintiff's motion for attorney representation 4 is granted. The Court recruits Brian J. Hickey of Cassiday Schade LLP, 2056 Westings Avenue, Suite 250, Naperville, IL 60563, to represent Plaintiff in accorda nce with counsels trial bar obligations under the District Court's Local Rule 83.37 (N.D. Ill.). After investigation, counsel should notify the Court by April 28, 2016, if he wishes to proceed with the complaint on file or he intends to file an amended complaint. If consistent with his obligations under Rule 11 counsel is unable to file an amended complaint, he should so inform the Court. [See STATEMENT] Signed by the Honorable Frederick J.
