March 14, 2018 Opinion or Order Filing 122 EXECUTIVE COMMITTEE ORDER: IT IS HEREBY ORDERED that the above captioned case 18-cv-379 be reassigned to the calendar of Judge Frederick J. Kapala. Signed by Honorable Ruben Castillo on 3/14/2018. (jp, )
March 13, 2018 Opinion or Order Filing 119 ORDER Adopting Report and Recommendations: Before the court is a report and recommendation ("R&R") #118 from the magistrate judge that 18 CV 379 be reassigned based on relatedness. Accordingly, there being no written objection to the R&R, see 28 U.S.C. 636(b)(1); Fed. R. Civ. P. 72(b); Thomas v. Arn, 474 U.S. 140, 149-50 (1985), and the court having reviewed the record and the R&R, the court accepts the R&R and finds that 18 CV 379 and this case are related and that 18 CV 379 should be reassigned from the Eastern Division to Judge Kapala in the Western Division. A copy of this finding will be forwarded to the Executive Committee together with a request that the Committee reassign 18 CV 379 from the Eastern Division to Judge Kapala in the Western Division. Signed by the Honorable Frederick J. Kapala on 3/13/2018: Electronic notice (kms)
February 26, 2018 Opinion or Order Filing 118 REPORT AND RECOMMENDATIONS; The Report and Recommendation dated 2/2/2018 is amended to add the following: In support of its recommendation that 18 CV 379 be reassigned based on relatedness, the Court agrees with the determination by Judge Consuelo Marshall of the Central District of California that both cases share a similarity of issues of fact or law, see Dkt. 109, Ex. C at 3-4. See Local Rule 40.4(a)(2). In addition, the Court finds that both cases are pending in this Court, reassignment is likely to result in a substantial saving of judicial time and effort because of the similarity of issues and defendants, the parties to this case are not yet at issue and discovery is limited to initial disclosures and so it has not progressed to the point where reassignment would likely cause delay, and because of the similarity of issues and defendants the cases are susceptible of disposition in a single proceeding. See Local Rule 40.4(b). Any objection must be filed by 3/12/2018. Failure to object may constitute a waiver of objections on appeal. See Provident Bank v. Manor Steel Corp., 882 F.2d 258, 260 (7th Cir. 1989). Signed by the Honorable Iain D. Johnston on 2/26/2018: (yxp, )

February 2, 2018 Opinion or Order Filing 114 ORDER, REPORT AND RECOMMENDATIONS; Status and motion hearing held on 1/30/2018. The MSP Recovery Claims plaintiffs in the case pending in the Eastern Division, 18 CV 379, do not object to the defendants' motion to reassign #109 that case to the Western Division. January 26, 2018 Opinion or Order Filing 112 MINUTE entry before the Honorable Iain D. Johnston: The Mallinckrodt defendants have filed a notice of motion providing notice that they will present their motion to reassign #109 telephonically. Dkt. 110. As the Court has stated in multiple places on its webpage including its standing order on General Status and Motion Practice, "[c]ounsel or a party must appear in person for the presentment of a motion.Every motion must be noticed for presentment on a specific date in accordance withLocal Rule 5.3(b)except for those motions specifically identified in the Courts standing order on Agreed Motions." In particular, the standing order warns that "[n]oticing a motion forpresentment telephonically does not get around the Court's requirement that motions be presented in person." Accordingly, the presentment of the Mallinckrodt defendants' motion to reassign #109 on 1/30/2018 at 1:30 PM shall be in person. The telephonic status hearing previously set for that same day and time shall now also require personal appearances of counsel. (yxp, )

Presentment of the motion set for 1/30/2018 is stricken. However, the parties are warned that documents that "influence or underpin a judicial decision are open to public inspection unless they meet the definition of trade secrets or other categories of bona fide long-term confidentiality." Baxter Int'l Inc. v. Abbott Labs., 297 F.3d 544, 545 (7th Cir. 2014). Accordingly, if any of the redacted material influences or underpins the district judge's decision on the motion to dismiss, the relevant portions may be unsealed. (yxp, )
