For the following reasons, defendant's motion to transfer to the Central District of California 45 is denied, its motion for judgment on the pleadings 52 is granted, and Count III of plaintiff's complaint is dismissed with prejudice extent the claims therein are brought pursuant to 810 ILCS 5/2-314. The parties are directed to file a revised proposed case management order by January 31, 2019. The telephonic status hearing set for February 28 is stricken and reset to February 7 at 9:00 AM. By February 5, 2019, counsel shall provide direct-dial numbers for the hearing to the Courts operations specialist, who will initiate the call. (See attachment for full detail.)
