ORDER:Plaintiffs application for leave to proceed in forma pauperis #3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $59.93 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. As this is Plaintiffs second case in this district in which leave to proceed in forma pauperis has been granted, see Ford v. Haney, 18 C 50030 (Dkt. 7) (of which he has paid $152.60 toward the filing fee and owes $197.40), 40% of his monthly income must be devoted toward his filing fees, where that income meets the requirements of the PLRA. The Court directs the Clerk of Court to: (1) send a copy of this order to the trust fund officer at Shawnee Correctional Center; (2) file Plaintiffs complaint #1 ; (3) issue summonses for service of the complaint on Defendants by the U.S. Marshal; and (4) send Plaintiff filing instructions and a copy of this order. The Court appoints the U.S. Marshal to serve Defendants using the 285 Forms provided by Plaintiff 5 . Plaintiffs motion for attorney representation #4 is denied without prejudice to later renewal.
