ORDER: Before the court for preliminary review is Deonta M. Newtons 2255 motion. Rule 4(b) of theRules Governing Section 2255 Proceedings for the U.S. District Courts requires a district courtto conduct preliminary review of 2255 motions. The rule states that [i]f it plainly appears fromthe motion, any attached exhibits, and the record of the prior proceedings that the moving partyis not entitled to relief, the judge must dismiss the motion. Newtons motion does not withstandRule 4(b) review because he has failed to allege sufficient facts to support a claim for relief.Newtons allegations amount only to an assertion of Ineffective Assistance of counsel in thatMy lawyer violated my six[th] amendment. Therefore, Newtons motion is dismissed withoutprejudice to filing an amended 2255 petition within 30 days stating the facts supporting hisineffective assistance of counsel claim.
