ORDER signed by the Honorable Philip G. Reinhard on 11/2/2018: The court grants the plaintiff's renewed application for leave to proceed in forma pauperis #6 . The court authorizes and orders the trust fund officer at the plaintiff's place of incarceration to deduct $29.53 from the plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The court directs the Clerk of Court to send a copy of this order to the trust account office at the Whiteside County Jail. However, summonses shall not issue at this time. The plaintiff's motion for attorney representation #4 is granted. The court requests that Christopher A. DeRango / DeRango & Cain, LLC / 321 West State Street, Suite 700 / Rockford, Illinois 61101 / (815) 962-5490 / [email protected] represent the plaintiff in accordance with counsel's trial bar commitment under Local Rule 83.37 (N.D. Ill.). The complaint on file is dismissed without prejudice to plaintiff's counsel filing an amended complaint by December 3, 2018, assuming counsel can do so consistent with Rule 11 of the Federal Rules of Civil Procedure. The recruited attorney falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States, therefore, the above-named attorney shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above-captioned only. The recruited attorney is directed to open a separate PACER account to be used only for this case, and fees are exempt for this case only. The assigned attorney shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of the attorney's participation in the matter. ORDER signed by the Honorable Philip G. Reinhard on 10/1/2018: The plaintiff's motion to proceed in forma pauperis ("IFP") #3 is denied, without prejudice. The court directs the plaintiff to submit a renewed IFP application that is certified by a trust fund officer; he must also attach copies of his jail trust fund ledgers showing his income for the six months preceding the initiation of this action [that is, from March 10, 2018, through September 10, 2018]. Failure to comply by November 2, 2018, will result in denial of leave to proceed IFP and summary dismissal of this case. The court instructs the Clerk of Court to provide the plaintiff with a blank IFP application along with a copy of this order. Because the plaintiff reports an inability to obtain a trust account statement, the court additional directs the Clerk of Court to mail a copy of this order to the Whiteside County Sheriff.
