Filing 8 ORDER: Plaintiffs motion to reconsider the 10/31/2018 order dismissing his claims #7 is denied. Thecases cited in the courts 10/31/2018 order stand for the stated propositions of law. First, therewas no mistake of law by the Chief of Police. The 30 mile-per-hour speed zone, in which plaintifftraveled 47 miles per hour, was indisputably established and posted. The question becamewhether that speed zone was lawful. The Chief of Police was not obligated to refuse to testify atplaintiffs bench trial once plaintiff presented him with the case law which, according to plaintiff,demonstrated the illegality of the speed zone. On the contrary, the Chief of Police was requiredto give his factual testimony at the bench trial. It was for the state trial court to determine whetherthe speed zone was lawful.
