| Filing 5 MINUTE entry before the Honorable Philip G. Reinhard: Defendant removed this action from state court premising subject matter jurisdiction on diversity of citizenship (28 U.S.C. 1332). Defendant alleges it is a dissolved Tennessee corporation but it is actually a dissolved Tennessee limited liability company (LLC). The citizenship of an LLC is the citizenship of each of its members. The identity of each member and each members citizenship must be alleged to establish diversity of citizenship jurisdiction. Defendant also fails to allege the state of citizenship of decedent, Gary Fink, which is the controlling citizenship for the legal representative of a decedent's estate. 28 U.S.C. 1332(c)(2). On or before February 7, 2019, defendant shall file amended jurisdictional allegations identifying the member or members of defendant and each member's citizenship and the citizenship of decedent, Gary Fink, or this case will be remanded to state court for lack of subject matter jurisdiction.
