See Walton v. United Consumers Club, Inc., 786 F.2d 303, 306 (7th Cir. 1986) ("Courts... have refused to enforce wholly private settlements [of FLSA claims]."); Salcedo v. D'Arcy Buick GMC, Inc., 227 F. Supp. 3d 960, 961 (N.D. Ill. 2016) ("[D]istrict courts in this Circuit routinely require approval of FLSA settlements."); see also Morgan v. CSW Inc., No. 16-C-1283, 2017 WL 3161148, at *3 (E.D. Wis. July 25, 2017) ("Although the Second Circuit did not resolve the question of whether a dismissal without prejudice requires court approval under Rule 41, a district court in Florida has held that a stipulated dismissal of a FLSA action requires court approval for any settlements regardless of whether the dismissal is with or without prejudice."). Given that the parties are requesting this Court to dismiss without prejudice to allow for possible enforcement of a FLSA settlement agreement, by 5/15/2020, the parties shall file the settlement agreement and a memorandum supporting that the agreement represents a fair and reasonable resolution of the dispute.
