Filing 10 ORDER: Plaintiff may proceed on his complaint to the extent set forth in this Order. The Court directs the Clerk of Court to (1) file Plaintiff's complaint #8 ; (2) dismiss and terminate Defendant Varga; (3) amend the caption to reflect that Defendant C.O. Reveniq is the sole Defendant; and (4) send Plaintiff a magistrate judge consent form, filing instructions, and a copy of this order. Summons, however, will not yet issue. Plaintiff's motion for service at government expense #4 remains under review. Because Plaintiff has paid the filing fee and is not proceeding in forma pauperis ("IFP"), he is not necessarily entitled to service at government expense. Fed. R. Civ. P. 4(c)(3). By October 11, 2019, Plaintiff must submit: (1) either (a) a Service Statement indicating that he will provide a $250.00 deposit for service (service costs generally range between $65.00 and $250.00) at the request of the Marshals Service; or (b) a completed IFP application along with certified trust fund account information from July 28, 2018, through the date of the Plaintiff's application; and (2) a completed USM-285 service form for Defendant Reveniq. A completed service form must be received before service efforts may begin. Should he fail to comply with these instructions by that date, this case will be dismissed. Plaintiff also must promptly submit a written change-of-address notification if he is transferred to another facility or released, or this action will be subject to dismissal with prejudice.
