Filing 3 MINUTE entry before the Honorable Iain D. Johnston: Upon review of the plaintiff's complaint, the Court notes that the allegations in support of diversity jurisdiction are deficient. For instance, the plaintiff alleges her residence, not citizenship. Meyerson v. Harrahs East Chicago Casino, 299 F.3d 616, 617 (7th Cir. 2002). Same for the individual defendant. As for the corporate defendant, she does not allege its state of incorporation and principal place of business -- instead of a state, she identifies a judicial district. Dalton v. Teva North America, 891 F.3d 687, 690 (7th Cir. 2018). See also "Know the Answer to Federal Jurisdiction," available on this Court's webpage. Finally, the allegations of damages appear to include a typographical error: "damages are in excess of Fifty Thousand Dollars ($75,000.00)." Dkt. 1 at 5. By 10/21/2019 plaintiff's counsel shall file an amended complaint to cure any deficiencies in her allegations of diversity jurisdiction. (yxp, ) |
