January 21, 2020 Opinion or Order Filing 16 ORDER: On December 18, 2019, the Court found that Plaintiff was ineligible to proceed in forma pauperis because he has "struck out," acknowledged Plaintiff's claim that he was arranging payment, and ordered Plaintiff to pay the full fee by January 17, 2020, to avoid dismissal. The Court also (among other things) advised Plaintiff that an audit indicated that he owed $950 in filing fees in Cases Nos. 85 C 3194, 86 C 7186, 88 C 7208, 90 C 7078, 96 C 2986 (the Court corrects this case number, it should be 95 C 2986), and 06 C 2564 and directed Plaintiff to pay or explain why he should be allowed to initiate new lawsuits while his debt to the Court remains unpaid. The following day, the Clerk's Office received a $450 payment from Plaintiff. It applied $400 to this case; as of January 17, 2020, the remaining $50 is still in the queue of payments requiring further attention but will eventually be applied to any outstanding filing fee obligations. Plaintiff subsequently submitted a letter #12 and two motions #13 #14 vigorously disputing that he had filed the prior cases identified by the Court, accusing the Court of engaging in extensive criminal misconduct, and asking for a new judge. Adverse rulings alone do not establish judicial bias, Liteky v. United States, 510 U.S. 540, 555 (1994), so Plaintiff's requests for recusal #13 #14 are denied. While the dockets of all of the cases identified by the Court bear Plaintiff's IDOC prisoner number and the Court normally relies on information maintained by the Clerk, in light of Plaintiff's submissions, a staff member ordered the underlying records for all but one of the cases from the Federal Record Center since they are not available electronically due to age. The Court will review them when they arrive. Documents from Case No. 06 C 2564, however, are available electronically and show that Plaintiff filed that case and owes $350 in filing fees. Finally, Plaintiff is warned that sanctions, such as dismissal or a request for the Executive Committee to limit his ability to initiate further litigation in this district, "may be appropriate when a party has shown a lack of respect for the court or proceedings," by engaging in inappropriate conduct, such as unfounded challenges to the Court's authority, "vitriol and frivolous accusations" about the Court, and accusations that the Court has engaged in criminal activity. See White v. Williams, 423 Fed. App'x 645, 647 (7th Cir. 2011) (collecting cases). Given Plaintiff's recent submissions, he is cautioned that if he continues with his present course of conduct, the Court will take appropriate action. Signed by the Honorable Thomas M. December 18, 2019 Opinion or Order Filing 10 ORDER: Plaintiff's application for leave to proceed in forma pauperis #5 is denied because Plaintiff has "struck out" under 28 U.S.C. 1915(g) and in any event, is not financially eligible to pay the fee in installments. Plaintiff indicates he is arranging payment of the filing fee #9 . To proceed, he must: (1) pay the $400 filing fee in this case; and (2) pay the $950 in outstanding filing fees he owes in Cases Nos. 85 C 3194, 86 C 7186, 88 C 7208, 90 C 7078, 96 C 2986, and 06 C 2564. If he claims that he cannot pay 100% of his past fees, he must: (1) explain, in writing and under oath (a) why the money he spent on personal items over the past years should not be counted against his ability to pay his past filing fees when he previously had the means to pay his debt to the Court and was warned that he would not be able to litigate new cases unless he did so and (b) why he should be allowed to initiate new lawsuits in this Court while his debt to the Court remains unpaid; and (2) submit updated certified trust fund ledgers beginning on November 22, 2019 (when his current ledgers end) and ending on the date of compliance. If Plaintiff fails to comply by January 17, 2020, the Court will summarily dismiss this action. Plaintiff's motions for attorney representation #4 #7 are denied without prejudice as this case is at its earliest stages, Pickett v. Chicago Transit Auth., 930 F.3d 869, 871 (7th Cir. 2019) (citing Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007) (en banc)), and in any event, nothing suggests that Plaintiff is unable to respond to this order, which calls for explanations regarding matters that are within his knowledge. Plaintiff's motion for a temporary restraining order #8 , which discloses his "struck out" status and seeks an order requiring the trust fund officer to pay the filing fee is denied due to Plaintiff's claim that a $450 payment was sent to the Clerk. Plaintiff is advised that the filing fee is $400. If Plaintiff caused $450 to be sent, the Clerk is directed to apply the extra $50 to Plaintiff's oldest case with outstanding fees (85 C 3194).
