February 5, 2020 Opinion or Order Filing 8 ORDER: The Court grants Plaintiff's application to proceed in forma pauperis #3 and orders the trust fund officer at Plaintiff's place of incarceration to deduct $16.03 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to make monthly deductions in accordance with this order. The Clerk is directed to: (1) file Plaintiff's complaint #1 and (2) issue summonses for service of the complaint on the Defendants. The Court on its own motion and in its discretion requests that Timothy Bernard Cantlin of The Cantlin Law Firm, 760 E. Etna Road, Ottawa, IL 61350, represent Plaintiff in this case in accordance with counsel's trial bar obligations under the District Court's Local Rule 83.37 (N.D. Ill.). The recruited attorney falls within the class of users listed in the Electronic Public Access fee schedule adopted by the Judicial Conference of the United States, therefore, the above-named attorney shall be exempt from the payment of fees for access via PACER to the electronic case files maintained in this court for the above-captioned case only. The recruited attorney is directed to open a separate PACER account to only be used for the above-captioned case, and fees are exempt for the above-captioned case only. The attorney shall not be exempt from the payment of fees incurred in connection with other uses of the PACER system in this court. This exemption is valid immediately and for the duration of the attorney's participation in the matter. This exemption may be revoked at the discretion of the Court at any time. The attorney shall contact the PACER Service Center at 1-800-676-6856 or via the link below to create the new PACER account and to make any necessary arrangements for the waiver. A copy of this order shall be sent to (electronically if possible): (1) the PACER Service Center at http://www.pacer.psc.uscourts.gov/register.html; (2) the Systems Department of the Northern District of Illinois; (3) the Court's Fiscal Department; (4) the trust fund officer at the institution currently having custody of Plaintiff; (5) recruited counsel; and (6) to Plaintiff, at his institutional address, along with five USM-285 service forms. The Court advises Plaintiff that a completed USM-285 form is required for service on each Defendant, so Plaintiff must promptly return a completed form for each Defendant. The U.S. Marshal is appointed to serve Defendants. Counsel is encouraged to review this order and visit the Pro Bono Resources for Trial Bar Attorneys available on the Court's homepage for resources related to pro bono representation.
